EPA May Reverse New Rule!!!

Pre-Publication Copy of the Proposed Risk Management Program (RMP) Reconsideration Rule

EPA’s Administrator, E. Scott Pruitt, signed the following proposed rule on May 17, 2018, and EPA is submitting it for publication in the Federal Register. ON June 14, 2018 @ Washington DC, EPA will hold a public hearing the new proposed RMP rule.

The hearing will provide interested parties the opportunity to present data, views, or arguments concerning the proposed Risk Management Program (RMP) Rule. EPA will make every effort to accommodate all speakers who arrive and register.

The sessions will run from:

  • 9:00 AM to 12:00 Noon,
  • Break: 12:00 Noon and 1:00 PM,
  • 1:00 PM to 4:30 PM,
  • Break: 4:30 to 5:30 PM, and
  • continuing from 5:30 PM to 8:00 PM.

Persons wishing to pre-register may be assigned a time according to this schedule. Speakers will be limited to 5 minutes for oral presentations. EPA may ask clarifying questions during the oral presentations, but will not respond to the presentations at that time.

The new proposed rule can reverse many to all of the items proposed in the filing in the federal register back in December 2016.  This means that the Obama’s driven new RMP rule (that stemmed from executive or 13650) may not now take effect  February 19, 2019 as proposed.
